ABBOTSFORD (NEWS1130) – A man accused of running down a flagger at a construction site on Lougheed Highway in Mission earlier this year, killing the worker, is expected in court this morning in Abbotsford.

Thor Shay is charged with driving without due care and attention after Don Cain was hit and killed in July.

There still seems to be a lot in dispute over what exactly happened, which is why Diane Herback with the BC Flagging Association says flaggers plan on showing up today to give Cain’s sister some support.

“For her, she’s just trying to make sense of it all,” believes Herback. “We as an Association don’t have the ability to change the laws, but maybe eventually when court cases like this happen, and the judges see more, maybe somebody will set a precedence and change the laws and make them more stiffer.”

Herback says the Association is also angry Shay wasn’t charged with a more serious crime.
