ABBOTSFORD (NEWS1130) – The man accused of hitting and killing a flagger at a construction site on Lougheed Highway in Mission has pleaded guilty in an Abbotsford courtroom.

Thor Shay was charged with driving without due care and attention after Don Cain was hit and killed in July 2010.

Diane Herback with the BC Flagging Association says the courtroom was full of emotion.

“A lot of the family spoke, but the most emotional was the traffic control person that was on site, that witnessed [Cain] being killed. She had just changed spots with him six minutes prior to his death,” notes Herback.

“We as an Association don’t have the ability to change the laws, but maybe eventually when court cases like this happen, and the judges see more, maybe somebody will set a precedence and change the laws and make them more stiffer,” she adds.

Herback maintains Shay should’ve been charged with a more serious crime.
