VANCOUVER (NEWS1130) – A  truck driver who was caught with more than a hundred kilos of pot in his trailer is getting a new trial.

At his trial, Ivo Banovic insisted he had no idea there was pot in his truck when he was pulled over in Golden in December, 2008.
He was making a run from Vancouver to Toronto and police found 13 weed-filled boxes hidden behind some pallets.
The trial judge didn’t buy Banovic’s story and found him guilty of possession for the purpose of trafficking.
The BC Court of Appeal is now tossing that ruling out, saying the evidence doesn’t show Banovic knew he was carrying drugs.
No new trial date has been set.
