A chance many BC drunk driving penalties could be overturned

VANCOUVER (NEWS1130) – Some drunk drivers caught in late 2011 might be catching a break. As many as 1,200 people could be affected.
A provincial review could affect drivers arrested in the days just before November 30th, 2011, when BC Supreme Court struck down a portion of the province’s tough new impaired driving law. It ruled that some of the immediate roadside prohibitions under that law were unconstitutional.
This could mean some people will not have to follow through with safe driving classes or install ignition interlock systems in their cars. Other penalties, like fines and impoundments, will not be overturned.
The government hasn’t decided if drivers who have already completed the responsible driver’s program will get their money back.
The course costs about $1,000. Ignition interlocks cost $1,700.
