Former PM among 13 taking local re-developers to court

VANCOUVER (NEWS1130) – Former Prime Minister Kim Campbell and 12 others are taking the re-developers of a Vancouver landmark to court.

The complaint involves pre-sale condos at the Hotel Georgia.

Campbell and the rest of the buyers each paid a $368,000-deposit for a unit inside the 48-storey downtown high-rise, thinking it would be finished by the end of 2011 — but it wasn’t.

“Every developer in British Columbia is required to disclose certain information to pre-sale purchasers,” explains lawyer Bryan Baynham.

“One of the things that they’re required to disclose is when the unit and the development as a whole is going to be completed. If that changes, they have a positive obligation to file an amendment,” he tells us.

“The developer simply didn’t do that. Because they didn’t do it, they’re precluded from enforcing the contract, which means that each and every one of my clients is entitled to their deposit back,” adds Baynham.

The case goes to trial next January.
