BURNABY (NEWS1130) – It looks like many of the arrests of protesters on Burnaby Mountain may have been illegal.
The BC Civil Liberties Association says court documents suggest the RCMP has cordoned off the wrong area.
There’s been a lot of confusion up at the TransMountain survey site about where the court says protesters need to be.
Josh Paterson with the BCCLA says Kinder Morgan has applied to have the injunction site increased.
“Where the police line is now isn’t actually where the injunction is. So if you’ve been arrested for walking over that line you may not have, in fact, breached the court order.”
It’s unclear what that means for the dozens of protesters charged.
Many of them won’t appear in court until next year.
