Trans Mountain protester asking court to dismiss lawsuit filed against him

VANCOUVER (NEWS1130) – A Burnaby man is heading to BC Supreme Court this morning, hoping a judge will throw out a lawsuit filed against him by Kinder Morgan.

The lawsuit is over the man’s activism against the Trans Mountain expansion project.

Alan Dutton is one of five protesters Kinder Morgan named in a civil suit and today, he’s attempting to get the case against him tossed.

He feels it’s within his right to demonstrate and this lawsuit interferes with his basic democratic rights. As a result, he’s asking the court to order the company to pay him special costs.

Back in November, the BC Supreme Court granted the company an injunction which ordered protesters not to interfere with survey work on Burnaby Mountain.

The BC Civil Liberties Association has labelled the suit against the five protesters as a so-called SLAPP suit, an acronym for Strategic Lawsuit Against Public Participation.
