Former Mountie free pending conviction appeal

VANCOUVER (NEWS 1130) – A former Mountie sentenced to jail for lying at a public inquiry is free pending appeal of his conviction.

BC Supreme Court judge Nathan Smith sentenced former corporal Benjamin “Monty” Robinson to two years less a day Friday for lying to an inquiry into the death of Polish immigrant Robert Dziekanski.

The sentence also includes one year probation and 240 hours of community service.

Robinson’s lawyer David Crossin says an appeal of the conviction has been filed, and Robinson has been released from custody pending the appeal. Robinson was the senior officer in charge on October 14th, 2007, when Dziekanski was wrestled to the ground at Vancouver’s airport and then repeatedly jolted with a Taser.

Smith found Robinson guilty in March, saying he and three other officers had concocted a false story to tell homicide officers, and then lied to the public inquiry to explain why their first statements didn’t match with an amateur video that was later released.
