BC father who killed his 3 children doesn’t meet high-risk accused: lawyer

NEW WESTMINSTER (NEWS 1130) – The lawyer for a man found not criminally responsible for killing his three children says his client doesn’t fit the narrow definition of a high-risk accused.

Rishi Gill told a BC Supreme Court judge that Allan Schoenborn’s mental-health treatment still has a long way to go and he is dealing with serious anger issues, but that doesn’t put him in the high-risk category.

A Crown attorney has asked the court to label the 49-year-old man high-risk, a designation that would severely limit his outings into the community and extend his annual review hearings to once every three years.

An earlier murder trial found Schoenborn was experiencing psychosis at the time of the killings in 2008 and he believed he was saving his daughter and two sons from sexual and physical abuse, though no evidence suggested this was the case.

Gill has said does not intend to dispute the “brutal nature” of his client’s offences.

The Crown has argued Schoenborn’s lengthy history of violence means he poses an unacceptably high risk to public safety.
