The Holmes Hydro project consists of ten different plants on the Holmes River. A Supreme Court judge says, as such, it is not subject to the Environmental Assessment Act.

VANCOUVER (NEWS1130) – A coalition of environmental groups has lost a court case, revolving around environmental evaluations of a run-of-river project near McBride.

As it stands now, assessments are only needed when a hydroelectric power project will generate more than 50 megawatts of electricity.

The Holmes Hydro project is exempt because, while it will generate 76 megawatts, it will do so with ten separate generation sites.

Karen Campbell with Ecojustice, which represents the David Suzuki Foundation and Watershed Watch Salmon Society, says they are disappointed.

“The Holmes River is a river that has Chinook salmon that feeds the Fraser River system. But what we were really concerned about was how the Environmental Assessment Act is applied in British Columbia.”

The concern is that many other run-of-river projects about to go on line will also dodge assessments by splitting operations.

“We are worried about is poorly-drafted laws. Many of the laws that have been rewritten in the past ten years are much weaker. They are much more discretionary and they don’t protect the environment nearly as well as before that,” says Campbell.

She says they are taking heart, in that the judge did say the act should have been better drafted.

Jamieson Glendinning pled guilty to three counts of indecent assault. One of his young victims was seven when the abuse began.

SURREY (NEWS1130) – A former Tsawwassen baseball volunteer will be spending the next two years in jail, after pleading guilty to sexually assaulting three youths back in the 1960s and 70s.

Jamieson Glendinning, 63, pled guilty to sexually assaulting three youths, one as young as seven when the abuse began.

The kids, two males and one female, were abused over a span of many years, between 1969 to 1979.

Glendinning was sentenced to three years plus three months for the three counts of indecent assault and for failing to appear in court. He was given credit for time already spent in custody.

Right before his preliminary hearing last summer, Glendinning disappeared.

Thanks to a Crimestoppers picture, someone in Sydney, Australia recognized him and he was deported back to Canada last fall.

Crown counsel’s Winston Sayson says during sentencing, the judge praised the victims.

“The judge commended them for their strength, courage and will to carry on with their lives. He says the passage of time did not render the offence any less serious,” he notes.

“The court recognized that the victims were vulnerable, innocent and trusting youths, who were physically and emotionally impacted by the offence.”

Glendinning offered an apology to the victims and his own family during sentencing.

The victims are not linked to Glendinning’s work with the Tsawwassen Amateur Baseball Association.

SURREY (NEWS1130) – Last month, four Lotto ticketholders shared the biggest Lotto 6/49 jackpot in Canadian history, totalling $63 million.

Two of those ticketholders, both in Surrey, still haven’t come forward. Split four ways, each winning ticket is worth $15.8 million.

So why haven’t the two Surrey ticketholders come forward yet?

Chris Fairclough with the BC Lottery Corporation has a couple of theories.

“It’s not unheard of for lottery winners to wait a couple of weeks before they come forward. I’ve seen it in my time at the BCLC. People are on vacation, so they don’t know they’ve won, which was the case with a $25 million winner last year. Many times they have the ticket in their wallet or on their fridge,” he notes.

“It could also be that they’re talking to their financial advisor.”

The largest unclaimed prize in BC was back in 2009, for $130,000.

Lottery winners have 52 weeks to come forward to claim their prize.

PITTSBURGH, PA (NEWS1130) – Sidney Crosby had a hat trick before the game was 22 minutes old, and the Penguins held off the Senators to win 4-3 and take a 2-0 series lead in their NHL Eastern Conference semi-final.

Crosby had the Pens on the board first, three minutes into the game.

Ten minutes later on an Ottawa power play, New Westminster’s Kyle Turris potted his fourth of the post-season.

Crosby struck again before the first period was over and then the Penguins captain completed the hat trick 75 seconds into the second period.

That was it for Sens goalie Craig Anderson, who was replaced by Robin Lehner.

Ottawa responded with a goal by Colin Greening 40 seconds later, before Brendan Morrow wrapped up the scoring for Pittsburgh six minutes later.

Pens goalie Tomas Vokoun stopped break away chances by Greening and Cory Conacher before the second period ended. Pittsburgh was up 4-2 after two periods.

Ottawa’s Jean-Gabriel Pageau cut the lead to 4-3 early in the third period, but the number one seed in the Eastern Conference held on.

Lehner made 20 stops in his relief appearance in goal.

Game 3 goes in Ottawa on Sunday.

OTTAWA – Sen. Pamela Wallin is leaving the Conservative caucus, the second senator in as many days to do so amid a storm of allegations of dubious expense claims.

Wallin’s travel expenses — $321,000 since September 2010 — have been the subject of an external audit since December.

In a brief written statement, Wallin — a former CTV broadcaster — says she has been co-operating fully with the auditors and had expected the process to be complete by now.

Since it is ongoing, Wallin says she’s decided to recuse herself from the Conservative caucus.

The decision comes after fellow former broadcaster Sen. Mike Duffy stepped down from the Tory caucus Thursday amid controversy about his housing expenses — and where he got the money to pay them back.

The Prime Minister’s Office admitted earlier this week that Nigel Wright, Stephen Harper’s chief of staff, footed the $90,000 bill for Duffy.

“There’s a greater awareness to the issues around homophobia. Canada was one of the first pioneers to have same-sex marriage at the national level but now we’re seeing the momentum in the United States and other countries,” says Noble Kelly with the Pride Education Network.

That momentum includes three US states voting in favour of legalizing same-sex marriage in the last year (Maryland, Maine, Washington), bringing the total number of states to 12 plus Washington DC.

“It’s often a political topic that many politicians, as part of their platforms, need to start addressing and have been. I think that’s another milestone that we’ve seen happen in recent history,” says Kelly. He adds it’s fully legal across 14 countries.

Kelly also makes note of Jason Collins, who earlier this month became the first professional athlete to come out.

OTTAWA – Geoff Gowan, a member of the Order of Canada for his contribution to coaching and a longtime voice of track and field in this country, has died. He was 83.

Gowan died Thursday night in Halifax after a lengthy struggle with Parkinson’s disease, according to a release from the Coaching Association of Canada (CAC).

Gowan, a former CAC president, worked for the coaching organization for 25 years.

“Geoff was an outstanding leader in Canadian sport, and influenced thousands of athletes, coaches, and colleagues in sport management and the media. He has been a friend, role model, and mentor to myself and many others in Canadian sport, and will be deeply missed,” CAC chief executive officer John Bales said in a statement.

A lasting tribute to Gowan’s leadership is the annual Geoff Gowan Award, which recognizes lifetime contribution to coaching development.

Many of Canada’s top coaches have won the award, including Jack Donahue, Doug Clement, Al Morrow, Donald Dion, Charles Cardinal, Andy Higgins, Tim Frick, Allison McNeill, Lyle Sanderson, Dru Marshall and Keith Russell.

Through his work with the CAC, Gowan was instrumental in the training of more than a million coaches through the development of the National Coaching Certification Program, considered to be among the best coaching education programs in the world.

The member of Canada’s Sports Hall of Fame also was a well-known broadcaster, covering track and field for the CBC at the Olympic Games and world championships.

Gowan was awarded the Order of Canada in 1992. He also received an honorary doctorate in civil law from Acadia University for his service to sport in Canada.

Details on funeral arrangements have not been released.
