VANCOUVER (NEWS1130) - A class action lawsuit against
Air Canada is a step closer to being certified after a BC Supreme Court judge ruled against the airline earlier this week. A passenger claims a fuel surcharge was misrepresented as a tax on his tickets.
A passenger named Bulent Unlu claims Air Canada disguised the charge on his $340 ticket to make it look like a tax being collected by the government instead of money that was going to the airline.
The BC Supreme Court struck down the airline's claim a BC law doesn't apply to Air Canada because it's federal company.
Lawyer Jim Poyner says that means they'll have a certification hearing soon, as long as the airline doesn't appeal. "The airlines have been doing this, charging these fees, for years and on a daily basis."
He adds a lot of people paid that fee, just like Unlu. "Millions of dollars have been collected and we'll be seeking information from the airline as to the people who paid those fees, so we're in a position to get them compensated."
Lufthansa is named in the suit as well.
