VANCOUVER (NEWS1130) - He was found guilty on Friday of conspiring to traffic 100 kilograms of cocaine into Abbotsford but Jarrod Bacon may never do any time for the crime.
His lawyers may file a motion of entrapment. It's not something that's done very often, only when the defendant and defence lawyers believe there was a set up by police.
News1130 legal analyst Michael Shapray says, "If that's the case, the police sting would have been unconstitutional. The lawyers will file an application for a stay of proceedings based on an allegation that their client was entrapped by the police to engage in whatever criminal conduct they were convicted of."
Police can appeal a successful entrapment argument but if they lose -- the case is closed forever. The motion can only be filed after a guilty verdict and before sentencing -- that's exactly where Bacon stands right now.
