Report: Use of Taser against Dziekanski not justified

Inquiry commissioner Thomas Braidwood claims explanations for use of force 'patently unbelievable'

VANCOUVER (NEWS1130) - A public inquiry into Robert Dziekanski's death has concluded the RCMP officers involved were wrong to use a Taser on him at YVR.

Inquiry commissioner Thomas Braidwood says the senior officer intervened in an 'inappropriately aggressive' manner and says the two other officers, during their testimony, offered 'patently unbelievable' information after-the-fact realizations.

Braidwood also says Dziekanski did not bring this upon himself. He says he didn't believe the officers when they said they didn't talk about the incident before being questioned by IHIT investigators, but he added he didn't think they colluded to fabricate a story.

As for the Canada Border Services Agency, Braidwood says he is appalled Dziekanski could be in their waiting area for up to five hours before being helped.

He does credit YVR with its passenger assistance changes, but says more can be done. The major recommendation is that B.C. develop a civilian-based criminal investigative body, to look into all police-related incidents throughout the province and no members be police officers.

Finally Braidwood apologized and offered his sympathy to Dziekanski's mother Sofia Cisowski. She says she will sleep better tonight and has high praise for Braidwood. She also hopes the Crown will still consider charges against the four officers.

Braidwood says Dziekanski's death 'shocked and repulsed' people all over the world. The commissioner released an earlier report from another set of hearings that concluded the stun guns can kill and their use should be restricted.
