IIO submits report after fatal shooting involving Surrey RCMP

SURREY (NEWS 1130) – The Independent Investigations Office (IIO) is submitting a report to Crown Counsel that could lead to charges in relation to a fatal shooting involving Surrey RCMP.

It was July 18th, 2015 when 20-year-old Hudson Brooks was shot and killed outside the District 5 RCMP detachment on 152nd street in South Surrey.

Brooks family says he was not suicidal though he was described as in distress.

When he confronted police, he was shot and killed.

Marten Youssef with the IIO says they are not recommending charges.

“We don’t recommend charges, we don’t even recommend which charges should be approved. Under the Crown Counsel act the Criminal Justice Branch has the full jurisdiction over the charge assessment and charge approval process,” he says.

Youssef says the threshold for referral to Crown is lower for the IIO than for other law enforcement agencies in the province.

“They have a two part test. Essentially, if there is a substantial likelihood of conviction based on the evidence and of course the second, the prosecution must be required in the public interest.”

The officer or officers involved have not been named.
